New Lead Paint Regulations: Impact on Affordable Housing Development in NYS
This workshop will provide an introduction to the new HUD regulations governing the treatment of lead-based paint hazards and an important discussion of how these rules will affect development projects. These new regulations will affect any Federally funded rehabilitation (among other Federally funded activities), including projects to which HOME and CDBG funding is committed/obligated after that date. Few units— only certain elderly and 0 BR units — will be exempt.
Under these new rules, surfaces that will be disturbed by rehab will have to be tested, and risk assessments, interim controls and (in some cases) abatement may be required. Not only will this affect the scope and cost of many rehabilitation projects, it also will affect procurement and oversight of certain contractors.
Although existing HOME and CDBG projects generally are not affected by the new regulations, it is essential that you begin as soon as possible to incorporate these guidelines into your planning for any future projects.
